En les presents Condicions Generals de Venda, les paraules que figuren a continuació tindran el següent significat:
  • Establiment: persona física o jurídica que ofereix béns i serveis per a la venda.
  • Client: una persona física o jurídica que fa una compra a l'establiment.
  • Beneficiari: fa referència a la persona física o jurídica que rep el servei i gaudeix dels béns venuts per l'establiment.
  • MyBeezBox: solució informàtica que permet a l'establiment comercialitzar ofertes de bons regal, targetes regal, etc. MyBeezBox no actua com a venedor.
  • Bo regal: oferta comercial que permet al client oferir un servei predefinit al beneficiari que escolli.
  • Certificat regal: oferta comercial que permet al client oferir un import que el beneficiari ha de gastar amb l'establiment.
  • Oferta: fa referència a una oferta comercial, com ara un bo regal o un certificat de regal que ofereix l'establiment.
  • Bo bescanviable: fa referència a una confirmació de compra que resumeix totes les condicions d'ús de l'oferta per part del beneficiari.
Les presents condicions generals de venda se celebren entre:

  • D'altra banda, el client.
L'establiment Marketplace QA (Wood PLC) utilitza la solució MyBeezBox per oferir ofertes de venda en línia, disponibles a través del https://marketplace-qa-agency-website-url.com. En aquest cas, MyBeezBox és el proveïdor de la solució informàtica, només l'establiment realitza la venda.

Aquestes Condicions Generals de Venda que regulen els termes i condicions de venda d'ofertes per part de l'establiment Marketplace QA (Wood PLC), li aconsellem que les consulti detingudament abans de comprometre's.
Aquestes condicions s'apliquen a la venda en línia d'ofertes per part de l'establiment.
Aquestes Condicions Generals de Venda (CGV) són vàlides a partir del 30 agost 2018. Substitueixen qualsevol altra forma de condicions generals de venda anteriorment vigents relatives a la venda d'ofertes comercials.
La institució es reserva el dret de modificar els CGV, encara que aquesta modificació és inaplicable als contractes celebrats amb anterioritat respectant els CGV associats a aquestes vendes.
Qualsevol client, abans de comprometre's, certifica poder celebrar un contracte d'acord amb els termes dels articles 1123 i 1224 del codi civil.
Abans de formalitzar un contracte, cada client ha de llegir i acceptar les condicions generals de venda de l'establiment.
Article 2.1
Les ofertes estan disponibles a la pròpia web de l'establiment venedor, en forma de serveis específics de l'establiment, que es poden complementar amb opcions subjectes a l'acord de l'establiment.
Les fotos i vídeos que descriuen els serveis de les diferents ofertes no tenen caràcter contractual.

Article 2.2
Les ofertes es poden comprar en línia a la pàgina web https://marketplace-qa-agency-website-url.com.
La consideració d'aquesta compra per part de l'establiment suposa el pagament íntegre del servei.
En comprar en línia, el client és redirigit a una plataforma segura gestionada per MyBeezBox i el seu soci bancari HomelocPay, aquest al seu torn és soci de Mangopay Advent International.
És responsabilitat del client omplir les seves dades personals de manera que l'identifiqui tal com preveu l'article 1316-1 del codi civil.
En el cas que el client no sigui el beneficiari de l'oferta, aquest es mantindrà automàticament informat d'aquesta compra mitjançant diferents mètodes de lliurament posats a disposició del client.
Durant el pagament, l'establiment certifica que posa a disposició del client un enllaç per accedir a les presents CGV.
Els preus publicats a la web de l'establiment inclouen tots els impostos.
Al preu de l'anunci de servei s'afegirà el preu de les opcions, així com el relatiu a l'enviament, efectiu només en cas d'enviament del bo bescanviable per correu postal.
L'establiment es reserva el dret de modificar els preus, sense aplicació retroactiva a les vendes celebrades amb anterioritat a aquesta modificació.
Article 4.1
L'establiment proposa ofertes dins dels límits de la seva disponibilitat i capacitat.
L'oferta es pot utilitzar per als serveis esmentats en els detalls del servei publicats en línia, qualsevol reclamació relativa a un servei no previst a l'oferta, incloses les opcions, pot no ser acceptada.

Les ofertes són vàlides durant un període de temps especificat per l'establiment en el moment de la compra, el període de validesa comença a partir de la data de compra i no des de la data de reserva en la pàgina web.

L'establiment es reserva el dret de fixar les dates de disponibilitat dels serveis. Aquests estan disponibles per a consulta en el moment de fer la reserva.
En cas que se superi aquest període de vigència, l'oferta no és reemborsable i es considerarà adquirida per l'establiment.

Les ofertes estan subjectes exclusivament a la venda mitjançant pagament amb targeta bancària Visa, Mastercard o Carte Bleue.
Les dades bancàries relatives a la targeta utilitzada pel client s'han d'introduir als camps corresponents, és a dir, el número de la targeta, el codi de seguretat, el nom del titular i la data de caducitat de l'esmentada targeta.
Tal com preveu l'article L.133-8 del Codi Monetari i Financer, el pagament amb targeta és un compromís irrevocable, un cop donat.
